Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of mycespace.com, your My CE Space account, and the online continuing education courses and related services offered by My CE Space, LLC (collectively, the "Services").

By visiting the website, creating an account, purchasing a course, or using the Services, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.

1. About My CE Space

My CE Space, LLC is a Texas continuing education provider serving barbering and cosmetology professionals.

Approval of a provider or course by the Texas Department of Licensing and Regulation (TDLR) does not mean that TDLR endorses My CE Space or guarantees any particular professional, licensing, or employment outcome.

2. Eligibility and Your Agreement

You must be legally able to enter into this agreement. If you are under 18, you may use the Services only with the permission and supervision of a parent or legal guardian, and any payment must be authorized by an adult.

Your electronic acceptance of these Terms has the same effect as a written signature to the extent permitted by applicable law.

 3. Accounts and Student Information

You may be required to create an account to purchase or complete a course. You agree to:

- provide complete, current, and accurate information;
- provide the correct name and TDLR license number for the person completing the course;
- promptly correct inaccurate account or license information;
- keep your login credentials secure;
- use only your own account; and
- notify us promptly if you believe your account has been accessed without authorization.

Each account is for one individual student. You may not share an account, complete coursework for another person, permit another person to complete coursework for you, impersonate another person, or misrepresent your identity, license status, participation, or course completion.

You are responsible for errors or delays caused by inaccurate information you submit. We may request additional information reasonably necessary to verify identity, eligibility, payment, or course completion.

4. Course Enrollment and Access

Course descriptions, prices, availability, included materials, and any stated access period are shown on the website at the time of purchase. We may update course content, presentation, or features to maintain accuracy, accessibility, regulatory compliance, or instructional quality, provided that the course continues to satisfy the material description applicable to your purchase.

Purchasing a course gives you a limited, personal, nonexclusive, nontransferable right to access and complete that course during the applicable access period. Enrollment may not be resold, transferred, or shared.

Access requires a compatible device, a supported web browser, and a reliable internet connection. You are responsible for your own device, internet service, and related costs.

5. Course Participation and Completion

My CE Space may allow you to begin designated course content before payment. This limited preview or early access does not constitute completion of the course. Payment is required to unlock the remaining required content and final completion step.

To receive completion credit, you must personally complete all required course content, instructional time, acknowledgments, assessments, identity checks, payment step, and other requirements associated with the approved course. The course is completed only after all required steps have been satisfied. Completion credit and certificate eligibility will be determined according to the approved course requirements and applicable TDLR rules.

Attempting to skip, automate, falsify, manipulate, or bypass course requirements is prohibited. We may withhold completion, suspend access, invalidate a completion record, or report suspected misconduct when reasonably necessary to protect the integrity of the course or comply with law.

You may not receive continuing education credit for completing the same course more than once when prohibited by TDLR requirements.

6. Certificates and TDLR Reporting

After you successfully complete an approved course, My CE Space will:

- make a course-completion certificate available within 15 days after course completion; and
- submit the required electronic course-completion report to TDLR no later than seven days after the course-completion date.

You should download and retain your certificate for at least two years after the completion date. If your completion is not reflected in TDLR records after seven days, contact My CE Space so we can review the submission.

Upon request, My CE Space will provide a participant with copies of that participant's course-completion records within 10 days of the request, subject to reasonable identity verification.

Course completion does not itself renew your license. You remain responsible for confirming your individual continuing education requirements, completing any other renewal requirements, submitting your license-renewal application, paying required government fees, and verifying that your license has been renewed. Requirements can vary based on license type, license history, and applicable law.

7. Orders and Payment

Prices are displayed before purchase. Applicable taxes, discounts, and the total charge will be shown during checkout. By submitting an order, you authorize the charge shown and represent that you are authorized to use the selected payment method.

An order is accepted when we provide confirmation or make the purchased course available in your account. If an order cannot be accepted or fulfilled, we may cancel it and return any amount collected for that order.

Unless clearly stated at checkout, course purchases are one-time purchases and are not recurring subscriptions. We may correct obvious pricing or description errors. If a correction materially affects an order you already placed, we will contact you and provide an appropriate option to confirm or cancel the affected purchase.

8. Refunds and Cancellations

Refund eligibility is governed by the Refund Policy displayed on our website at the time of purchase and by applicable law. If you purchase a course but have not accessed or started it, you may request a refund. Once course materials have been accessed, started, or completed, a refund may be limited or denied because of the digital nature of the course and the need to preserve accurate completion records.

If My CE Space cancels a course or cannot provide access because of an issue within our control, we may offer a refund, course transfer, rescheduled access, extended access, or another reasonable resolution, as appropriate.

Nothing in these Terms limits any refund or cancellation right that cannot legally be waived. To request assistance with a purchase, contact support@mycespace.com and include the purchaser's name, account email, course, purchase date, and reason for the request.

9. Acceptable Use

You may not:

- violate any law, regulation, licensing requirement, or third-party right;
- copy, record, reproduce, publish, sell, distribute, or create unauthorized derivative works from course content;
- share course materials, assessments, answers, credentials, or certificates;
- interfere with website security, access controls, operation, or other users;
- introduce malicious code or use automated tools to scrape, copy, or manipulate the Services;
- submit abusive, threatening, discriminatory, defamatory, obscene, fraudulent, or unlawful content;
- use the Services to send spam or unauthorized solicitations; or
- attempt to gain unauthorized access to any account, system, or data.

10. Intellectual Property

The website, course materials, videos, audio, text, graphics, branding, assessments, downloads, and other content supplied by My CE Space are owned by or licensed to My CE Space and are protected by intellectual-property laws.

You may use course materials only for your personal education and license-compliance purposes. No ownership rights are transferred to you. Any use not expressly permitted by these Terms requires prior written permission.

11. Communications

You agree that we may send transactional and service-related communications concerning your account, purchases, course access, completion, certificates, support requests, security, and changes that affect the Services. These communications are necessary to administer your account and are separate from optional marketing communications.

If you opt in to marketing communications, you may unsubscribe at any time using the link provided in the message or by contacting us. Unsubscribing from marketing will not stop necessary account or course communications.

12. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference. We may use service providers to operate the Services, process transactions, communicate with users, secure accounts, maintain records, and comply with legal obligations.

13. External Links and Resources

The Services may contain links to government websites or other external resources. Those resources are provided for convenience and may change without notice. My CE Space does not control external websites and is not responsible for their availability, content, security, or privacy practices.

TDLR and other government sources control their own licensing rules, records, forms, fees, and processing times. If information on our website conflicts with an official government source, the official source controls.

14. Availability and Changes to the Services

We work to keep the Services available and accurate, but temporary interruptions may occur because of maintenance, updates, internet or telecommunications failures, security events, legal requirements, or circumstances outside our reasonable control.

We may modify, suspend, or discontinue a feature when reasonably necessary. If a technical interruption, severe weather event, emergency, or other disruption affects your ability to complete a course, contact us. Depending on the circumstances, we may provide technical assistance, extended access, rescheduled access, a course transfer, a refund, or another reasonable resolution. If a material change prevents you from accessing a paid course that remains within its stated access period, we will provide reasonable assistance or another remedy required by law.

15. Suspension and Termination

We may restrict, suspend, or terminate access if we reasonably believe that you have violated these Terms, engaged in fraud or misconduct, threatened the security or integrity of the Services, failed to pay an amount due, or created legal or regulatory risk.

When appropriate, we may give notice and an opportunity to correct the issue. Serious misconduct, identity fraud, course-completion fraud, security threats, or unlawful activity may result in immediate action. Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, and dispute resolution.

16. Disclaimers

My CE Space provides continuing education and related general information. We do not provide legal advice, and we do not guarantee license renewal, employment, income, business success, or any other particular outcome.

Except for obligations that cannot lawfully be excluded, the Services are provided on an "as available" basis. We do not promise uninterrupted or error-free operation or compatibility with every device, browser, or internet connection. We do not disclaim any express commitment stated in these Terms or any warranty that cannot be disclaimed under applicable law.

17. Limitation of Liability

To the maximum extent permitted by law, My CE Space will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost business opportunities, or loss of data arising from or related to the Services.

To the maximum extent permitted by law, My CE Space's total liability arising from or related to a course, purchase, or the Services will not exceed the amount you paid to My CE Space for the specific course or service giving rise to the claim.

These limitations do not apply to liability that cannot be limited or excluded under applicable law.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your intentional misconduct, fraudulent completion activity, unlawful use of the Services, infringement of another person's rights, or material violation of these Terms.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Services must be brought in a court of competent jurisdiction located in Harris County, Texas.

Before filing a legal claim, you and My CE Space agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing 30 days for a response. This informal-resolution requirement does not prevent either party from seeking urgent injunctive relief or filing a claim before an applicable limitations period expires.

20. Changes to These Terms

We may update these Terms to reflect changes in the Services, business practices, or applicable requirements. The updated Terms will be posted with a revised effective date. Material changes will apply prospectively unless a different application is required by law. Your continued use of the Services after the updated Terms take effect constitutes acceptance of the revised Terms.

21. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the maximum extent permitted by law. Our failure to enforce a provision is not a waiver. You may not assign your account or rights under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, sale of assets, or other lawful business transfer.

These Terms, together with the Privacy Policy, Refund Policy, and any course-specific terms shown at purchase, constitute the entire agreement between you and My CE Space concerning the Services.
